Exclusive Books: Goosebumps competition – Terms & Conditions

1. This competition (“Give us Goosebumps”) may only be entered into by residents of South Africa who are between the ages of 9 and 15 years.

2. No entrants whose parents or legal guardians are employees and immediate family members of employees of any division of Jadeite Trading PTY LTD, any supplier of goods or services in connection with this competition, any other person who directly or indirectly controls, or is controlled by, them, or any spouse, life partner, parent, child, brother, sister, business partner or associate of any such persons, may enter into the competition.

3. These rules/terms may be amended by reasonable notification via the Exclusive Books website at any time during the competition, and will be applied and interpreted by Exclusive Books(Group) and their decision regarding any disputes relating to such meaning and/or content will be final and binding.

4. Participation by the entrants in the competition constitutes an agreement to abide by these rules.

5. The competition is a short story writing competition, where entrants are required to write their own original short story of 5000 words. The winning entrant will be contacted via email and/or phone call. The competition runs from 15 October to 25 November 2015.

6. The prizes are not transferable, exchangeable or redeemable for cash and, to the maximum extent permitted in law, Exclusive Books, and its subsidiary and holding companies are not liable for any defects in the prizes.

7. Exclusive Books may, before or after the winner of the competition has been publicly announced, require that the parent or legal guardian of the winners permit the use of their image and/or name in their marketing material and/or participate in their marketing activities (including endorsing, promoting and/or advertising the services of, Exclusive Books, or any of their subsidiary or holding companies) (“the Invitation”). The winner has the right to decline the Invitation by telephone or email to colleenw@exclusivebooks.co.za on tel: 011 798 0000 within 5 (five) days of being notified that they are the winner of the competition, then such winner shall be deemed to have accepted the Invitation and granted permission and/or agreed to participate in the manner as aforesaid.

8. To the fullest extent permitted by applicable law (but not otherwise) the promoter and its agents assume no responsibility and are not liable for the non-availability, loss, interception or interference with, late receipt or damage of or to any prize claim, promotion-label, sticker, prize or notification or other communication, (other than those warranties or conditions implied by statute and which cannot be excluded by the promoter) any representation, warranty, condition or guarantee in respect of a prize, or any taxes, fees, charges or other costs which winners may be required to pay at any time in connection with a prize, (save to the extent that the promoter has expressly and specifically accepted responsibility in these rules/terms for the same). All prizes remain the property of the suppliers, pending delivery to winners and the Promoter is not responsible for the supply of, and does not own, any prizes provided by other suppliers nor acts as their agent in relation to the delivery to winners of prizes other than those supplied directly by the Promoter.

9. For any prize which must be claimed by the winner’s parent/legal guardian, the Promoter will not be obliged to award it to anyone other than that parent/legal guardian, if the winner is under 18.

10. The Promoter may also withhold that award should the Promoter determine in its sole discretion that a dispute may have arisen as between the winner and the parent/legal guardian in relation to the prize.

11. This competition shall comply with, and will be subject to, any peremptory provisions of the Consumer Protection Act (“CPA”) and the regulations promulgated thereunder, which are deemed to be incorporated herein (“Peremptory Provisions”). In the event of any conflict between these rules/terms and the peremptory provisions, the latter shall prevail. Copies of the CPA and the regulations promulgated thereunder are available on the Department of Trade and Industry website: www.dti.gov.za.

12. Any provision of these rules/terms or the competition which is held to be invalid or unenforceable shall be ineffective to the extent of such invalidity or unenforceability without invalidating or rendering unenforceable the remaining provisions thereof.
